Privacy Policy

This Privacy Policy applies to www.rudddevelopment.com (the “Site”) and covers the activities of Rudd Development Co Inc and Rudd Construction LLC (collectively, “Rudd,” “we,” “us,” or “our”). Each is a separate legal entity, and the entity responsible for your information depends on the service you are engaging us for:

  • Rudd Development Co Inc — residential property management, real estate development, design services, and related owner services
  • Rudd Construction LLC — general contracting, service and repair work, and related construction services

This Privacy Policy explains how we collect, use, share, and protect information about you when you interact with the Site, apply for housing, reside at or visit a property we manage, engage us as a construction or design client, or otherwise interact with our services.

By using the Site or our services, you agree to the practices described in this policy.

Section 1Information We Collect

We collect information directly from you, automatically through your use of the Site, and from third parties such as background-check vendors, prior landlords, and project partners.

Categories of personal information we collect:

  • Identifiers — name, mailing and email address, phone number, government-issued ID, date of birth
  • Financial information — income, employment, bank and payment-card information, credit-history information (for tenant screening, AR/AP, and lien-rights compliance)
  • Sensitive personal information — Social Security Number or similar identifier, collected only for tenant screening or for 1099/W-9 tax reporting, and background-check results. We do not use or disclose sensitive personal information for any purpose other than these limited business purposes.
  • Tenancy information — lease terms, payment history, maintenance requests, communications, occupant and pet information, vehicle information
  • Client and project information — for construction, repair, and design clients: project address and scope, plans, drawings, design briefs, photographs of the site, contract terms, change orders, payment history, communications
  • Vendor and subcontractor information — business contact details, licensing and insurance information, banking and payment information, lien waivers and related documents
  • Owner and investor information — for property owners and investors we work with: business contact details, ownership and entity information, banking and payment information, communications
  • Commercial information — applications, services requested or received, contracts entered into
  • Audio and electronic information — call recordings and transcriptions, as described in Section 4
  • Internet and device information — IP address, browser type, operating system, device identifiers, pages visited, links clicked, and similar data collected via cookies and analytics
  • Inferences — drawn from the above to evaluate applications, scope work, and manage active engagements

We do not knowingly collect “consumer health data” as defined under the Washington My Health My Data Act, and we do not process personal information for purposes covered by that statute.

We collect information when you submit a rental application, request a quote or bid, contact us, sign a lease or contract, pay an invoice, request service or maintenance, visit a property or job site, or use the Site.

Section 2How We Use Your Information

We use information to:

  • Process rental applications, including identity verification and tenant screening
  • Manage active tenancies, including communications, rent collection, lease enforcement, and maintenance
  • Scope, bid, contract, perform, and invoice construction, repair, and design work
  • Manage relationships with property owners, investors, vendors, and subcontractors
  • Send service notifications, including SMS text messages where you have provided consent
  • Operate, maintain, and improve the Site and our services
  • Comply with legal obligations including fair housing, landlord-tenant, contractor-licensing, lien-rights, accounting, and tax laws
  • Detect and prevent fraud, security incidents, and other prohibited activity
  • Pursue our legitimate business interests and the interests of the property owners and clients we serve

Section 3SMS / Text Messaging

By providing your mobile phone number and opting in, you consent to receive SMS text messages from Rudd related to your tenancy, your project, your inquiry, or your account. Message types may include:

  • Maintenance request confirmations and updates
  • Rent due reminders and payment confirmations
  • Lease renewal, showing, and inspection notifications
  • Construction and repair scheduling, status updates, and completion notifications
  • Design and project consultation scheduling
  • Invoice and payment notifications
  • Emergency and safety notifications
  • Other transactional and service-related messages

Message frequency varies based on your interaction with us. Message and data rates may apply. Reply STOP at any time to opt out of SMS messages. Reply HELP for assistance, or contact us using the information at the bottom of this policy.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Information sharing related to SMS is limited to subcontractors that directly support our messaging operations (such as our telecommunications and messaging service providers), and only to the extent necessary to deliver messages you have requested.

Consent to receive SMS messages is not a condition of any purchase, lease, service, or contract.

Section 4Phone Calls, Recording, and AI-Assisted Communications

When you call Rudd, your call may be answered by an automated or AI-assisted virtual receptionist, and your call may be recorded and transcribed for quality assurance, training, accuracy, dispatch, and record-keeping purposes. Consistent with Washington’s all-party consent requirements (RCW 9.73.030), you will be notified at the beginning of the call that the call may be recorded. If you do not consent to recording, you may end the call and contact us in writing using the information at the bottom of this policy.

Call recordings, transcripts, and AI-generated summaries are treated as confidential business records and retained consistent with Section 10.

We do not collect or enroll biometric identifiers (including voiceprints, fingerprints, or facial scans) as defined under the Washington Biometric Privacy Act (RCW 19.375). Our AI-assisted call handling does not use voice biometrics to identify or authenticate callers. If we ever introduce features that would collect biometric identifiers, we will provide notice and obtain consent as required by RCW 19.375 before doing so.

Section 5How We Share Information

We share information only as needed to operate our business:

  • Between Rudd entities — Rudd Development Co Inc and Rudd Construction LLC may share information with each other when work flows across entities (for example, when Rudd Construction performs work at a property managed by Rudd Development), each acting as a separate data controller for its own services
  • Service providers — property management software (such as AppFolio), construction management and accounting software, telecommunications, AI-receptionist, and messaging providers, payment processors, background-check and tenant-screening vendors, design and engineering consultants, and maintenance contractors, each under obligations to protect your information
  • Property owners — for properties we manage, we share information relevant to the tenancy and the unit with the legal owner of the property, who may use that information for their own purposes and to comply with their own legal obligations
  • Project partners — for construction, repair, and design projects: architects, engineers, subcontractors, suppliers, inspectors, and permitting agencies as needed to perform the work
  • Legal and regulatory — when required by law, subpoena, court order, lien proceeding, or regulatory authority, or to protect our legal rights and the safety of residents, clients, staff, or property
  • Business transfers — in connection with a merger, acquisition, financing, or sale of business assets, including the sale of an individual property or contract

We do not sell your personal information, and we do not share your personal information for cross-context behavioral advertising.

We honor opt-out preference signals, including the Global Privacy Control (GPC) signal, where transmitted by your browser.

Section 6Tenant Screening and Automated Decision-Making

Rental applications are evaluated using a combination of human review and automated tenant-screening services provided by third parties. These services use algorithmic scoring against factors such as credit history, rental history, and income to produce a recommendation. Final decisions are made by Rudd Development.

Consistent with the Seattle Fair Chance Housing Ordinance (SMC 14.09) and applicable Washington law, we do not require disclosure of, ask about, or take adverse action based on arrest records, conviction records, or criminal history, with the limited exception of sex offender registry information for applicants required to register. Our screening criteria are made available in writing upon request, consistent with RCW 59.18.257.

If you are denied housing based in whole or in part on a screening report or other information obtained from a consumer reporting agency, you have the right under the federal Fair Credit Reporting Act and Washington’s Fair Credit Reporting Act (RCW 19.182) to receive an adverse action notice identifying the screening company, a copy of the report at no charge upon request, and to dispute the accuracy of the report.

Section 7Project Materials and Marketing Use

In the course of design, construction, and repair work, we may receive plans, drawings, photographs, specifications, and other materials from you, and we may create plans, drawings, renderings, and photographs in connection with your project. Ownership and use rights for these materials are governed by your contract with us. We may retain copies of project materials as part of our business records.

We may use photographs of completed exterior work and unoccupied interior spaces for portfolio and marketing purposes. We will not use photographs depicting identifiable residents, vehicles, personal property, or occupied units for marketing purposes without separate written consent.

Section 8Cookies and Tracking Technologies

The Site uses cookies and similar technologies for basic site functionality, analytics, and to improve user experience. You can disable cookies in your browser settings; certain Site features may not work properly without them.

Section 9Data Security and Breach Notification

We use commercially reasonable administrative, technical, and physical safeguards to protect your information. No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

We destroy or render unreadable personal information before disposal, consistent with RCW 19.215.

In the event of a security breach involving your personal information, we will notify affected individuals and applicable regulators consistent with Washington’s data breach notification statute (RCW 19.255) and other applicable laws.

Section 10Data Retention

We retain your information for as long as needed to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements.

  • Tenant records: at least seven (7) years after lease termination, consistent with Washington State law and tax requirements
  • Rental applications not resulting in a lease: at least two (2) years, consistent with fair-housing recordkeeping requirements
  • Construction and design project records: at least six (6) years after substantial completion (the Washington statute of repose for construction defects), and longer where lien or warranty obligations apply
  • Call recordings and transcripts: typically twelve (12) months unless retained longer for an active matter or as required by law
  • General business records: at least seven (7) years, consistent with tax and accounting requirements

Section 11Your Rights

Depending on where you live, you may have rights to access, correct, delete, or restrict the use of your personal information, to opt out of certain processing, and to receive a copy of the personal information we hold about you.

California residents have additional rights under the California Consumer Privacy Act, including the right to know the categories and specific pieces of personal information we collect, the right to delete, the right to correct, the right to limit the use of sensitive personal information, and the right not to be discriminated against for exercising these rights. We do not sell personal information or share it for cross-context behavioral advertising, and we honor Global Privacy Control signals.

Washington residents may have additional rights under the Washington My Health My Data Act and applicable consumer protection laws.

To exercise any of these rights, contact us using the information at the bottom of this policy. We may need to verify your identity before responding. We will respond within the timeframes required by applicable law.

Section 12Children's Privacy

Our services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us and we will delete it.

Section 13Third-Party Links

The Site may contain links to third-party sites. We are not responsible for the privacy practices of those sites. Review their privacy policies before providing any information.

Section 14Notice at Collection (California Residents)

At or before the point of collection, you are being informed that Rudd collects the categories of personal information listed in Section 1 for the purposes described in Section 2. We retain each category for the periods described in Section 10. We do not sell personal information or share it for cross-context behavioral advertising.

Section 15Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be posted on this page with a new “Last Updated” date. Continued use of the Site or our services after changes are posted constitutes acceptance of the updated policy.
